By accessing or using any services provided by Africa You Got I (“AYGI”), including our website, programs (Enter the Jungle, MarksWell, affiliate network), and related platforms (collectively, the “Services”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Services.

2. Eligibility
You must be at least 13 years old to use our Services. If you are under 18, you represent that you have obtained consent from a parent or legal guardian. Certain programs may have additional age requirements.

3. Accounts and Registration
When you register for a program or create an account, you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of any login credentials and for all activities under your account. AYGI reserves the right to suspend or terminate accounts that violate these Terms.

4. Affiliate and Agent Program
Participation in the AYGI Affiliate/Agent program is subject to additional terms provided in your affiliate agreement. Commissions and benefits are conditional on verified performance and adherence to program rules. AYGI may modify or discontinue the program at any time, with notice to active affiliates.

5. Competitions and Prizes
Enter the Jungle and other competitions are governed by specific rules available on the relevant program pages. Prizes are non-transferable and may be subject to verification of eligibility and compliance. AYGI reserves the right to disqualify any entrant for misconduct or rule violations.

6. Intellectual Property
All content on the AYGI website and materials (including text, graphics, logos, and software) is owned by AYGI or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express permission.

7. User-Generated Content
You retain ownership of content you submit (e.g., portfolio links, bios, creative work). By submitting, you grant AYGI a non-exclusive, royalty-free, worldwide licence to use, display, and promote that content in connection with our programs and mission. You represent that you have all necessary rights to the content you share.

8. Prohibited Conduct
You agree not to:

  • Violate any applicable law or regulation.
  • Impersonate any person or entity, or provide false information.
  • Upload harmful or malicious code.
  • Use the Services to send spam or unsolicited messages.
  • Interfere with the security or functionality of the Services.

9. Third-Party Links
Our Services may contain links to third-party websites or platforms. AYGI is not responsible for the availability, content, or practices of those sites. Access them at your own risk.

10. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AYGI DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AYGI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO AYGI, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification
You agree to indemnify and hold harmless AYGI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services, your content, or your violation of these Terms.

13. Termination
AYGI may suspend or terminate your access to the Services at any time, with or without cause, and without prior notice. Provisions that by their nature should survive termination will remain in effect.

14. Governing Law and Dispute Resolution
These Terms are governed by the laws of South Africa. Any disputes shall be resolved through binding arbitration in Johannesburg, in English, with each party bearing its own costs. You waive any right to participate in a class action.

15. Changes to Terms
We may revise these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website. Continued use after changes indicates acceptance.
